How to register a trademark in Kosovo
Trademarks in Kosovo are registered with the Industrial Property Agency (IPA) under the Ministry of Industry, Entrepreneurship and Trade. An EU trade mark does not extend to Kosovo, so international brands need a separate national filing — handled through a licensed local industrial property agent. The registration process, step by step
Step 1 — Clearance search
Search the Industrial Property Agency (IPA) register and, where relevant, EUIPO and WIPO records for identical and confusingly similar marks in your Nice classes. Filing without a search is the single most common cause of refusal.
Step 2 — Appoint a licensed local agent
Foreign applicants without a domicile or seat in Kosovo must be represented by a licensed industrial property agent. A simple signed power of attorney is normally sufficient — no notarisation or apostille in standard cases.
Step 3 — Classify goods and services
Kosovo applies the international Nice Classification. Official fees are calculated per class, so the class list drives both the scope of protection and the total cost.
Step 4 — File the application with the IPA
The application is filed with the Industrial Property Agency under the Ministry of Industry, Entrepreneurship and Trade, together with the mark representation, applicant details, class list and proof of fee payment.
Step 5 — Formal and substantive examination
The IPA checks formal requirements, then examines absolute grounds (descriptiveness, distinctiveness, public order). Office actions must be answered within the set deadline.
Step 6 — Publication and opposition
The accepted mark is published in the official bulletin. Third parties may file opposition during the statutory opposition window.
Step 7 — Registration certificate
If no opposition succeeds, the IPA issues the registration certificate. Protection runs 10 years from the filing date and is renewable indefinitely in 10-year terms.
