How to do a trademark search in Kosovo

A trademark search is the cheapest step in the whole registration process and the one that prevents the most expensive outcomes: refusal, opposition, or rebranding after launch. This guide sets out the search methodology used before filing at the Kosovo Industrial Property Agency.

The seven-step search process

    Define the exact sign you want to protect

    Decide whether you are protecting a word mark, a figurative mark (logo) or a combined mark. Word marks give the broadest protection because they cover the name in any typeface; logos protect the specific visual. Search both if you intend to file both.

    Choose the correct Nice classes

    Trademarks are searched and registered per class of goods and services under the Nice Classification (45 classes). A conflict only matters where the classes overlap or where the goods are considered similar, so misclassifying at this stage produces a false 'clear' result.

    Run an identical-mark search on the IPA register

    Search the Kosovo Industrial Property Agency register for the exact wording in your chosen classes. This catches direct blockers quickly, including pending applications that are not yet registered but already hold an earlier filing date.

    Run a similarity search

    Extend the search to phonetic variants, transliterations, Albanian and Serbian spellings, plurals, prefixes and suffixes, and visually similar logos. Most refusals and oppositions come from similar marks, not identical ones.

    Check adjacent registers and prior use

    Review EUIPO and WIPO records for marks that may later enter Kosovo, plus Kosovo business registry names, domain names and active market use. Unregistered but well-known marks can also be a basis for opposition.

    Assess the results in legal terms

    Score each hit for likelihood of confusion: similarity of the signs, similarity of the goods, and the distinctiveness of the earlier mark. The output should be a clear go / adjust / no-go recommendation, not just a list of hits.

    If clear, file immediately — Kosovo is first-to-file. If a conflict exists, options include narrowing the specification, adapting the sign, negotiating a coexistence or letter of consent, or challenging a vulnerable earlier mark for non-use.
