Kosovo trademark registration for software and SaaS brands
A software business can enter Kosovo without shipping a physical product or opening a local office. Its name may appear in an app store, a subscription portal, a reseller proposal or an enterprise contract. For foreign software and SaaS companies, trademark planning should follow the actual product and delivery model rather than a generic instruction to register a “technology brand”.

Distinguish the company name from the product name
Identify the name users see when they download, subscribe to or recommend the product. The corporate entity, platform, mobile application and separate modules may use different signs. List the commercially important names and show which one is intended for the Kosovo launch, rather than assuming a filing for the company name resolves every product-brand question.
Provide the exact spelling and any logo used in the interface or sales material. If the product is being renamed, explain the transition and identify the version requiring review. Product names that closely describe what the software does may raise distinctiveness questions, which should be assessed before investing in a major naming campaign.
Explain downloadable software and hosted access
Downloadable software commonly raises Class 9 questions, whereas software as a service and many hosted technology services are commonly considered under Class 42. A company may offer both. Describe the functionality, whether users download a copy, and whether the service is accessed remotely rather than instructing a filing for every technology-related class.
A mobile application used to access a hosted platform does not make the two descriptions interchangeable. Give your representative the delivery model and a clear, non-confidential product summary. The proposed specification should describe the actual goods and services, with terminology checked against the current Nice Classification.
Look beyond the software layer
Some platforms provide branded services in addition to software: financial services, telecommunications, education or business administration, for example. Those activities can raise separate classification questions. A brand used for software enabling an activity is not automatically the same filing case as a brand used to supply that activity directly.
Explain who performs the underlying service and what the customer contracts for. A booking application differs from the accommodation service booked through it, and accounting software differs from an accounting service. This distinction helps avoid a specification that looks broad but misses the commercial activity customers actually recognise.
Combine trademark research with naming checks
A domain name, company-register entry or available app-store name is useful operational information, but it is not proof that a trademark can be registered or used without conflict. Request a preliminary Kosovo trademark search and identify the relevant goods and services. Explain any abbreviations or alternate spellings used in marketing.
Ask for assessment of relevant similar earlier marks, not only identical matches. Keep the search instructions and the sign assessed on record. If the growth team changes the name after the review, obtain a fresh assessment instead of relying on a result for an earlier version.
Clarify reseller and development-partner permissions
Confirm which entity owns the product brand, particularly where a development company, holding company and reseller are involved. A Kosovo partner managing sales should not be named as trademark owner merely for administrative convenience. Explain acquisitions or group reorganisations that affect the owner’s details before filing instructions are finalised.
Discuss permitted reseller use of logos, local landing pages, translated product descriptions and account access. Software licensing, source-code ownership and trademark permission are different legal matters. A trademark application should not be presented as protection for the code itself or as resolution of a development-contract dispute.
Use a technical brief without exposing secrets
The first enquiry can state the proposed owner, home country, mark, product function, delivery model and planned Kosovo customers. Provide a logo where relevant and earlier trademark records as background. Source code, customer lists and private security documentation are normally unnecessary for explaining a brand-search request.
Ask for preliminary search scope, specification recommendations, document requirements and a written quotation. Confirm correspondence arrangements and any work excluded from the price. Once instructions are approved, keep the filed wording and application reference with the product’s legal records, separate from domain renewals and software licences.

Which classes are relevant to SaaS?
Class 42 is commonly considered for SaaS, and Class 9 may be relevant to downloadable software. The actual offering and specification need individual review.
Is an available domain enough to clear the name?
No. Domain availability and trademark clearance are separate questions. A preliminary trademark search should assess the sign and relevant goods or services.
Does trademark registration protect source code?
Not by itself. Trademarks concern brand identifiers; code ownership and other IP questions require their own assessment.
