How the procedure runs

  1. The application is published in the official bulletin — the opposition clock starts.
  2. Opposition deadline: normally three months from publication, and it cannot be extended.
  3. Filing of the opposition with grounds, evidence and the official fee.
  4. Notification of the applicant, with a reply period and often a cooling-off phase for settlement.
  5. Exchange of submissions: proof of use, market evidence, invoices and advertising.
  6. Decision: full refusal, partial refusal for some classes, or rejection of the opposition.
  7. Appeal within the statutory deadline if the outcome is unfavourable.
