The five most common forms of misuse
A competitor uses your name or a near-identical one
Same or confusingly similar sign on the same goods or services. With a registered mark this is the clearest case of infringement and the fastest to stop.
Counterfeit goods carrying your logo
Fakes entering the market or crossing the border. A registered mark lets Kosovo Customs detain shipments and lets you claim destruction of the goods.
Fake social accounts, shops and domains
Instagram, Facebook, TikTok and marketplace platforms remove infringing accounts and listings on the basis of a registration certificate — usually within days.
A distributor or former partner registered your name
Filing in their own name, often in bad faith. This is challengeable through invalidity proceedings and, where the facts support it, transfer of the registration.
Copycat packaging and visual identity
Imitating colours, shapes and layout to trade on your reputation. Trademark rights are combined with unfair-competition arguments here.
What to do, in order
1. Secure the right first
Without a registration in Kosovo you have very little to enforce. A free search tells you within hours whether your name is still available, or whether someone has already taken it.
2. Document the misuse
Screenshots with dates and URLs, invoices, photos of products, receipts from test purchases. Evidence collected properly is what decides a case later.
3. Cease-and-desist letter
A formal warning from a licensed agent, citing your registration number and a deadline. Most disputes in Kosovo end here, without cost or publicity.
4. Platform and customs action
Takedown requests to platforms and marketplaces, plus a customs application so infringing shipments are stopped at the border.
5. Administrative or court proceedings
Opposition or invalidity before API against a conflicting mark; civil action for injunction, destruction of goods and damages where needed.
Frequently asked questions
Can I stop someone using my brand if I never registered it in Kosovo?
It is very difficult. Kosovo follows first-to-file, so unregistered use gives you limited options — essentially unfair-competition arguments or, exceptionally, well-known mark status. Registration is what makes enforcement realistic.
How do I certify my trademark in Kosovo?
By registering it with the Kosovo Industrial Property Agency (API). After examination and a 3-month publication period you receive a registration certificate valid 10 years, renewable indefinitely.
How fast can I stop a copycat?
Once you hold a registration, a cease-and-desist letter usually produces a result within days or weeks. Platform takedowns are similarly fast. Court proceedings take longer but allow damages.
Someone registered my name before me — can it be cancelled?
Yes, in defined situations: bad-faith filing, non-use for five consecutive years, or conflict with an earlier well-known mark. We review the file and give you an honest assessment of the chances.
What does infringement cost the other side?
Depending on the case: an injunction, destruction of the infringing goods, compensation for damages and costs of proceedings — plus loss of any inventory detained at customs.
Do I need to be in Kosovo to act?
