1. Capture dated evidence

2. Confirm the scope of your right
Check your registration number, the classes covered, and whether the infringing use falls within identical or similar goods. Unregistered use can sometimes be defended, but only with strong proof of prior reputation.
3. Cease and desist letter
A formal written demand to stop the use, remove materials and confirm compliance in writing. A large share of regional disputes end here, without any official proceedings and at a fraction of the cost.
4. Platform and marketplace takedowns
Meta, TikTok, Google, Amazon and Shopify all run brand-owner reporting programmes. A registration certificate is the document that turns a complaint into a removal, usually within days.
5. Customs border measures
A registered mark can be recorded with customs so that counterfeit consignments are detained at import. This stops the goods before they reach retail, which is the cheapest point to intervene.
6. Court action
For persistent infringement: an injunction to stop the use, destruction of infringing stock, publication of the judgment, and damages for proven loss including legal costs.
When is there a real likelihood of confusion?
- Visual, phonetic and conceptual similarity of the two signs, assessed as a whole rather than element by element.
- Similarity of the goods or services and their distribution channels.
- Distinctiveness and reputation of the earlier mark — stronger marks get wider protection.
- Attention level of the average consumer in the relevant market.
- Actual evidence of confusion: misdirected orders, complaints, tagged posts, supplier mix-ups.
Identical signs are not required. It is enough that the public might confuse the two offerings or assume an economic link between them.
