Classification
Trademark classes in Kosovo
Classes decide how wide your protection actually is. Get them right and the registration covers your real business for the next decade; get them wrong and a competitor operates legally one class away from you.
How classification works
45 classes, two families
The Nice Classification splits everything a business can offer into 45 classes: 1–34 cover goods and 35–45 cover services. Kosovo's Industrial Property Agency applies the same international edition used by EUIPO and WIPO, so class choices travel with you when you expand.
Protection is class-bound
A registration only blocks others in the classes you filed, plus similar goods where confusion is likely. A clothing mark in class 25 does not stop an identical restaurant name in class 43 unless the mark has proven reputation.
Specifications matter as much as classes
Within each class you list the actual goods or services. Too narrow and a competitor operates just outside your wording; too broad and you invite objections or a non-use cancellation after five years.
Cost scales per class
In Kosovo our all-in filing starts at €250 for the first class, plus €40 for each additional class. Adding a class at filing is far cheaper than filing a second application later.
The classes businesses in Kosovo file most
| Class | Typically covers |
|---|---|
| 9 | Software, mobile apps, downloadable content, electronics |
| 25 | Clothing, footwear, headwear — the classic fashion brand class |

| 32 / 33 | Non-alcoholic drinks and beer (32) versus wine and spirits (33) |
| 35 | Retail, e-commerce, advertising, business consultancy |
| 36 | Financial, insurance and real estate services |
| 41 | Education, training, entertainment, events |
| 42 | IT services, software development, engineering, design |
| 43 | Restaurants, cafés, catering, hotels |
| 44 | Medical, dental, beauty and wellness services |
Five mistakes that cost real money
- Filing only for the product and forgetting class 35 when you also sell through your own shop or webstore.
- Copying a competitor's class list without checking that it matches your actual activity.
- Claiming an entire class heading you cannot use — a gift to any future non-use cancellation action.
- Ignoring future plans: a café planning packaged coffee needs classes 43 and 30 from day one.
- Using vague wording such as 'business services', which examiners routinely object to.

Frequently asked questions
How many classes should I register in Kosovo?
Most small businesses need one to three: the core goods or services, the retail class 35 if they sell directly, and one class covering a realistic 3-year expansion plan. More classes mean more cost and a higher non-use risk.
Can I add a class after filing?
No. A class cannot be added to a pending or registered application — you file a new application, pay the full fee again, and get a later priority date. Get the class list right before filing.
Do Kosovo classes match EUIPO and WIPO classes?
Yes. All three use the Nice Classification, so the same class numbers apply for a Kosovo national filing, an EU trade mark and a WIPO international registration. Note that an EU trade mark does not cover Kosovo, which needs a separate national filing.
What happens if I pick the wrong class?
You may get a registration that does not cover your actual business, leaving competitors free in the classes that matter. It is one of the most common and most expensive filing mistakes we correct.
How much does each extra class cost?
€40 per additional class on top of the €250 first-class package, covering official fees and our representation as licensed industrial property agents.
